The Delovoy Peterburg newspaper prepared an article in which experts analysed the current situation with labour disputes in St Petersburg. Anastasia Samusenko, Lawyer at Maxima Legal, spoke about the impact of the pandemic on the nature of labour disputes and outlined the main trends in labour law cases.

According to Anastasia, “the pandemic has influenced the structure of employment disputes in general rather than the application of the ’employee is a known weak party’ principle by the courts. As the crisis has become devastating for many sectors, there has been an increase in the number of employer-initiated dismissal disputes, disputes relating to the suspension of employees, sending them on unpaid leave, etc. At the same time, the general trend remains and the courts, when assessing the legality of the employer’s actions, proceed from the need to protect the interests of personnel and try to analyse the situation as fully as possible (including assessing not only the employer’s compliance with formalities and document procedures, but also the economic justification of its decisions and the absence of abuse of right)”.
