Konstantin Boytsov has told Novy Prospect the terms of recovery of over RUB 1.7 billion from Rosseti Lenenergo in favour of LOESK

 LOESK electricity grid company is trying to recover almost RUB 1 billion in debts for electricity transmission from Rosseti Lenenergo distribution grid company. Rosseti Lenenergo estimated the cost of the services rendered in December 2021 at RUB 0, due to the lack of an individual tariff to calculate the price. However, LOESK believed that the payment for electricity transmission services is stipulated by regulations for 2021 approved by the Committee for Tariffs and Pricing Policy of the Leningrad Region.

It should be noted that another dispute between the companies is being considered by a court in connection with a similar situation of non-payment of about RUB 795 million for electricity transmission in November 2021.

Konstantin Boytsov, Head of Energy  and Natural Resources Practice at Maxima Legal, explained Novy Prospect online punlishing that “the key will be the existence of a bilateral transmission tariff approved for the disputed periods for the purpose of settlement between the companies. Otherwise, it will be difficult to recover transit fees for the disputed period. It would be necessary to conduct a judicial examination of the calculation of the cost of services rendered”.
