Konstantin Boytsov has explained to the DP why premises owners may be denied the right to appeal against decisions of general meetings of owners

The State Housing Inspection (State executive agency of housing supervision over the activities of differenttypes of  housing management organizations in the subjects of the Russian Federation) intends to appeal to the Supreme Court of Russian Federation the verdict of lower court instances according to which the legality of the decision adopted by the general meeting of premises owners may be challenged only by the owners themselves. It should be noted that the department initiated an analysis of the minutes and revealed the absence of impassable quorum just in response to a complaint received in his address by one of the owners.

“The claims of owners to court  in case of direct appeal most often are not satisfied due to missed deadlines for appealing against decisions of general meetings, lack of influence of a particular owner’s votes on voting results at the general meeting, etc.”, Konstantin Boytsov,Head of Real estate and construction practice at Maxima Legal explained to the Delovoy Peterburg newspaper.
