Many Russian organisations, including state-owned ones, are now thinking about using open source software. One of the problems that cannot be solved in open source is the lack of ability to accurately identify the author of the software.

Specially for Summa Technology, an analytical portal on digital transformation in public administration, Maxim Ali, Partner and Head of IP/IT practice at Maxima Legal, spoke about the problems of copyright protection in digital products created on the basis of open source.

“Even if rights are infringed through ignorance, the company that uses the software is still liable. The non-profit organization or government agency will have to prove that they did their due diligence, reviewed the license and decided there was no other author of the software.

The second problem is the necessity to observe the conditions prescribed by the license,” Maxim Ali stressed.
