Maxim Ali has explained to Kommersant what kind advertisement the FAS might recognise as unethical

The Leningrad region’s FAS began proceedings against American Medical Clinic LLC after a woman with the slogan was displayed on the advertising posters for a plastic surgery clinic.

The Head of the IT/IP Practice at Maxima Legal, Maxim Ali, told Kommersant that it was not the first time that FAS had been concerned about advertising of plastic surgery. “In one case involving telephone advertising, the courts ruled that an image of a woman’s breast in conjunction with the phrase: “It’s good when there are two … SIM cards.” In another case involving an image of a small breast during the sale of apartments (“We have low prices and many complexes…”) was ruled to be unethical”, said Maxim Ali.

In practice, signs of sexism in advertising are among the most popular reasons for declaring advertising unethical, along with cases of insulting military symbols or using foul language, Maxim explained. “Therefore, companies that view the female body as a weapon for provocative advertising need to prepare in advance for possible litigation with the Federal Antimonopoly Service and the courts, and plastic surgery clinics should try to avoid exploiting the audience’s emotions”, summed up Maxim.
