Novaya Advokatskaya Gazeta has published an article titled “Banks are to collect their clients’ biometric data”, which considers the law passed by Parliament that allows for individuals to provide biometric details to their bank to then be provided with services remotely.

Maxim Ali, Senior Associate at Maxima Legal and Specialist in IP/IT matters, commented that in such situations law enforcement agencies will gain access to such databases although the procedure to provide such information is yet to be set out by the Russian government.

Maxim clarified that consent to provide banks with personal data is not subject to this law only, as Article 9 of the Data Protection law establishes that consent must be specific, informed and consciously given.

According to Maxim, the principle of limited the processing of personal data for specific, predetermined and legitimate goals in accordance with Part 2 of Article 5 of the law still applies.

“Further to this, individuals have the right to revoke their consent on the processing of their personal data on the basis of Part 2, Article 9 of the Data Protection law”, mentioned Maxim Ali.
