Maxim Ali has spoken with RBC about the consequences for Retro FM Legends of breaching the trademark of 80s stars

Members of the 80s German pop group Dschinghis Khan, known for their hits Dschinghis Khan and Moskau, started proceedings against Retro FM Legends who organised concerts in Moscow and St Petersburg. Wolfgang Heichel and Stefan Track claim that ex-members of the band do not have the right to perform under the name Dschinghis Khan.

“Compensation may be claimed in the amount of 10 thousand to 5 million roubles with the final amount is determined by the court, or for twice the value of a trademark licence”, explained Maxim Ali, Head of Intellectual Property & Information Technology Practice at Maxima Legal. However, according to Maxim, among the most common court measures are restrictions on the use of a trademark (under threat of a fine) and compensation.
