The majority of St Petersburg shopping malls failed to obtain the property tax benefits due to the fact that their code in the Russian National Classifier of Economic Activities does not match the one prescribed by law.  In this regard, the market participants asked the Federal Antimonopoly Service of the Russian Federation to check the city legislation on the discriminatory conditions.

Maxim Ali, Senior associate at Maxima Legal named the position of the shopping centers logical. The expert explained to the Kommersant newspaper, that courts have repeatedly recognised that code in the Russian National Classifier of Economic Activities is appropriated for statistical purposes and does not reflect what the organisation actually does. According to Maxim, the Federal Antimonopoly Service of the Russian Federation cannot change legislation or fine the Legislative Assembly, but the antitrust agency theoretically has the right to issue an order to St Petersburg Administration up to 50 thousand rubles.
