Sergei Bakeshin has commented to Delovoy Peterburg on litigation related to the theft of cargo

The Baltic Plant won a case for damages resulting from the theft of parts of warships that occurred during their transportation by rail. The cargo was protected during transportation by employees of the Federal State Unitary Enterprise, which the Commercial Court of St Petersburg and the Leningrad Region ordered to pay for the cost of lost components, estimated by experts to be valued at 1.85 million roubles. Currently representatives of the railways are trying to appeal the court decision.

Sergei Bakeshin, Head of Dispute Resolution and Insolvency Practice at Maxima Legal, told Delovoy Peterburg that litigating with the state and state-owned enterprises is becoming more and more difficult since the state prefers not to part with the money, but, on the contrary, to collect it from businessmen.

Disputes over the safety of goods themselves, according to the lawyer, can be conducted in several ways. “Firstly, it may be a dispute with the carrier itself. Secondly, it can be a dispute with an insurance company if the lost or damaged cargo was insured. And thirdly, it can be a dispute with the organisation with which an agreement was signed for the transportation and cargo protection. There are relatively few such disputes, and, as a rule, the non-departmental protection of the railway transport loses them,” Sergei Bakeshin stated.
