One of the key features of 2018 in the sector of insolvency became the largescale use by the commercial courts of subsidiary liability of controlling persons/entities for company debts. Last year 2,215 individuals and entities were made liable for the debts of their businesses, which is 2.3 times higher than the figure for 2017, and four times higher than the figure for 2016. The factors that have increased courts’ willingness to lift the corporate veil have been the toughening of legislation, including a significant expansion on the list of grounds for imposing liability on controlling persons.
