Federal PPP/PPP law: figures, facts and expert assessments // Expert Journal on Concessions and Infrastructure Investment – April 2020

The National Association of Concessionaires and Long-Term Infrastructure Investors has published an expert release “Federal PPP/PPP Law: figures, facts and expert estimates”. The material is analytical in nature and contains analysis of Russian PPP projects and market development perspectives.

The expert release is based on the information from the Registry of PPP, Municipal-Private Partnership Agreements of the Russian Ministry of Economic Development and Trade, as well as opinions of the key industry experts, including Natalia Diatlova, partner, head of PPP Practice at Maxima Legal.

Natalia drew attention to the current need to adopt amendments to the Federal Law No. 115-FZ On Concession Agreements of 21.07.2005. In her opinion, we need more freedom in regulating relations between the public partner and a private investor, including a foreign one. In addition, as the expert noted, “in parallel with concession agreements, various investment agreements, operating agreements, lease agreements with investment conditions and other types of contracts which, taking advantage of the provision on the free will of the parties in concluding the agreement, provided for other legal structures for implementing PPP projects.
