Sergei Bakeshin assessed for NP whether one of the creditors will be able to achieve the reintroduction of interim measures against the subsidiary of JSC Ladoga DSK
The Commercial Court of Arbitration of St. Petersburg and Leningrad Region cancelled interim measures in the form of prohibition for the temporary manager of LLC Trade House Ladoga DSK – a subsidiary of JSC Ladoga DSK – to hold a meeting of creditors. This decision was taken in connection with the consideration of all creditors’ claims. In particular, in July 2024, the court recognised Yuri Vorobyov’s claim for RUB 75 m as unfounded, having found that the debtor’s obligation to him had previously been terminated.
Sergei Bakeshin, Counsel, Head of Dispute Resolution and Insolvency Practice at Maxima Legal noted that this determination has not yet been appealed, so the court cancelled the interim measures and the interim manager appointed the first meeting of creditors. ‘If Yuri Vorobiev will file an appeal against the ruling on the refusal to include his claims, he will be able to apply for the introduction of new interim measures, but it will be difficult to do it in time for the remaining days before the meeting,’ – said the expert.
