Dmitry Uryakin has discussed with Pravo.ru the impact of postal errors on litigation

Pravo.ru legal edition has drawn attention to how the actions of postal staff affect the length of court proceedings or even on court decisions. For example, a breach of the retention period for court items can play a significant role, with the incorrect calculation of which a defendant is not considered to have been duly notified of the time and place of the court hearing. Also, leaving letters at reception or security in the business centre where the company rents an office, rather than delivering documents directly to the representative, may have legal consequences.

Dmitry Uryakin, Associate at Maxima Legal, told Pravo.ru that he had encountered cases when post office employees had given wrong address and index as well as name or the name of addressee. “Courts evaluate such mistakes and determine whether the letter was received by the addressee. If the letter was delivered to the addressee, legal consequences for the addressee have occurred. If not, the sender will be responsible for the mistake,” the expert explained.

Also Dmytry noted that postal employees often do not check attachments to the letter and do not check them against the inventory, stamping papers formally. As a result, unscrupulous senders may send only two documents instead of, say, five, or put blank sheets in the envelope altogether, the lawyer pointed out.
