Konstantin Boytsov has discussed with Novy Prospekt the key points of a dispute between the residents of an apartment building and its developer

In St Petersburg, a dispute lasting almost a year between the tenants and the developer of the Toyve has reached a conclusion. The owners of the apartments demanded a survey of the land under their homes, as well as the subsequent sale of part of the territory and non-residential premises in the residential complex to a private investor was illegal. However, the Krasnogvardeisky district court sided with the developer.

Commenting on the dispute ahead of the final hearing, the Head of Real Estate and Construction practice at Maxima Legal, Konstantin Boytsov, noted that “the project declaration posted on the developer’s website, which should be referred to in the claimant’s contract, provided for the allocation of a land plot for a non-residential building. The question of whether it is possible to consider the entering into an agreement on shared construction with reference to the project declaration as consent to construction, will be considered by the court.”
