Konstantin Boytsov has provided his comments to Pravo.ru on the law on adverse possession/’squatter rights’

Pravo.ru has published an article on the topic of individuals or entities acquiring rights to agricultural property. According to the law it is necessary to conscientiously, openly and continuously hold the property for at least 5 years and for real estate for at least 15 years. Nevertheless, according to current regulations, this rule does not apply to land plots.

“In land law there is not a concept of adverse possession for land plots. The regulations on public ownership to land should be publicly available, which is why an individual or entity that builds property on another’s land cannot be considered a bona fide builder and cannot acquire title to the land  (“Summary of court practice for cases connected with constructions without planning permission”, approved by the Supreme Court’s Presidium dated 19/03/2014)”, explained the Head of the Real Estate and Construction department at Maxima Legal, Konstantin Boytsov.
