On 19 October, the Southern and Central Federal Districts of the country introduced a high alert mode involving, among other things, “the imposition of control over communications and communication, computing centres and automated systems”. This could affect the operation of critical information infrastructure, including communication networks and data centres, according to participants in these markets. Owners of networks and data centres must provide full access to them at the request of the Ministry of Defense, possible disconnection of communications and increased control over the transfer of information. According to experts, interpretation of new conditions will depend on initiatives of the executive, to whom the blurred wording gives “room for manoeuvre”.

Maxim Ali, Partner and Head of IP/IT Practice at Maxima Legal, confirmed to Kommersant that the law has no specific definition of what an “automated system” and a “computer centre” are. “Whichever definition we choose, it will be broad in any case. But it is in the spirit of lawmaking of recent times to create such rules so that the authorities have carte blanche,” the expert explained.
