Maxim Ali told RAPSI about the amount of compensation for moral damages awarded by the courts

Recently, the problem of personal data leaks has become more and more urgent. For example, in 2019 information about Sberbank cardholders, in 2020 information about Muscovites who have contracted the coronavirus, and in 2022 information about customers of the Yandex.Food delivery service appeared on the web. At the same time, it should be taken into account that neither legislation nor court practice provide criteria for determining the amount of compensation for moral damages, which in fact may not even cover court costs.

For example, Maxim Ali, Partner and Head of IP/IT practice at Maxima Legal, told the Russian Legal Information Agency (RAPSI) that the courts may charge a symbolic amount of compensation: “we recall a story from 2016, when the Moscow Municipal Court awarded compensation of 1,000 rubles for a photo spread in a swimming costume with insulting comments. And in 2019, the same thousand roubles was awarded as a result of calls demanding payment of a non-existent debt”.
