Sergei Bakeshin told the Novy Prospect about the prospects of challenging the decision on the additional issue of PJSC Svetlana shares for 2.5 billion rubles

The minority shareholder of PJSC Svetlana tries to challenge in a court the decision of the general meeting of shareholders of the company to issue additional shares of 2.5 billion rubles.

Sergei Bakeshin, Head of Dispute Resolution and Insolvency Practice at Maxima Legal, explained the online publishing Novy Prospect that disputes on invalidity of decisions of meetings of participants of LLC and shareholders of JSC arise quite often. “Such claims are satisfied quite often. For example, in the first “quarantine” half-year of 2020, 205 such disputes were considered and in 69 cases the demands were satisfied”, pointed out the expert.

According to Sergei Bakeshin, the existence of the claim that challenges the decision of the general meeting of shareholders does not affect the implementation of the company’s plans. “If the court does not apply interim measures, there will be no obstacles for implementation of the decision of the general meeting of the shareholders of Svetlana and, accordingly, for the additional issue”, -summarized Sergei.
