Sergey Bakeshin has considered the lawfulness of blocking IP addresses connected with Telegram

On 13 April the Tagansky court in Moscow issued a judgement on the blocking of popular messaging app Telegram for its refusal to provide the de-encryption codes for its users’ correspondence to the FSB. Due to the nature of the app’s architectural, attempts by Roskomnadzor to restrict access to it has resulted in almost 20 million IP addresses of Amazon and Google’s cloud services being added to a black list and has interrupted the availability of more than 30,000 websites and apps used in everyday and business communication.

Senior Associate at Maxima Legal, Sergey Bakeshin, expressed his doubts as to the lawfulness of operators’ actions to limit access to resources as instructed by Roskomnadzor. “The law provides that providers are to block access to Telegram on the basis of the court judgement.  But this judgement has yet to come into effect”, commented Sergey to news site Fontanka.ru.

Those that have incurred losses as a result of the recent events may seek to recover damages from providers.  According to Sergey, after the judgement has been published and appealed before various courts, it may be possible to then apply to the ECHR.
