Dmitry Uryakin, Senior Associate at Maxima Legal, considered the positions of the parties and expressed his professional opinion on the case of exclusion of a person from a limited liability company specially for Vestnik Arbitrazhnogo Suda Moskovskogo Okruga (Bulletin of the Commercial Court of the Moscow District) magazine.
It should be noted that according to the assessment of the Commercial Court of the Moscow District, the lawsuit was a way to resolve the corporate conflict and raised the question of whether a participant may be excluded from the company for purposes unrelated to the removal of obstacles to the normal activity of the company caused by the conduct of one of the participants.
