Natalia Diatlova participated in the discussion of amendments to legislation within the Russian PPP Week 2020

Partner and Head of the PPP Practice at Maxima Legal, Natalia Diatlova, took part in the largest industrial event in Russia and the CIS – infrastructure congress ‘Russian PPP Week’. The event was an initiative of the National PPP Centre with the support of the Roskongress Foundation. Natalia Diatlova became an expert in the open debate named «The evolution of legislation. What changes does the market require?»

The Ministry of Economic Development of Russia has finalised a draft law providing for substantial amendments to legislation in the field of PPP. Some provisions of the bill are still controversial, and a number of important points remain beyond the current amendments. During the debate, experts discussed such topics as a legalisation of a budget financing formats, a compensation of expenses for preparation of private initiative, an introduction of the institute of special circumstances, an electronic auction, as well as issues that have not been taken into account in the current amendments to legislation.

In particular, Natalia Diatlova drew the attention on the minimum guaranteed income question. According to the expert, despite the practical development of this area, there is still no clear legislative definition of the minimum guaranteed income. The definition would allow having a legal basis in case of disputes.

Natalia also paid attention on the possibility of a public partner to take the burden of concluding agreements on electricity supply and their payment. In the expert`s opinion, this would increase an attractiveness of PPP projects.
In addition, Natalia agreed with her colleagues about the issue of legislative expansion of the wording of PPP project definition, which allows expanding the pool of attracted and initiated projects implemented under this mechanism.

Russian PPP Week has been held for 7 years and is the largest event in Russia on the issues of attracting investments into infrastructure development and discussion of problematic issues of PPP projects implementation. This year the program of the event as a whole was dedicated to the topics of attracting private investments into projects, optimization of the legislation taking into account modern investment mechanisms, expansion of concession and PPP application spheres. The Russian PPP Week annually gathers government officials, top managers of financial, investment, construction companies, legal and financial consultants and industry experts.
