Alina Esmanskaya told Pravo.ru how to challenge a bank transfer

If a money transfer has been made by mistake, it may be disputed. This applies both to transactions between individuals and to unjustified debits from organisations’ current accounts. Alina Esmanskaya, Associate of Private Wealth practice at Maxima Legal, spoke specifically for the industry portal Pravo.ru about the extrajudicial mechanism of money return.

The expert drew the portal’s attention to the fact that “the rules of international payment organizations provide for chargeback – a procedure whereby a payer disputes a particular transaction in order to get the money back into their account”. According to Alina, it requires substantial evidence of the illegality, error or validity of the transaction. “The Russian courts recognize the legitimacy of such a procedure (Case No. A40-150727/2019)”, the lawyer explained to Pravo.ru.
