Darina Lysachkina has written for ILN and JD Supra about the mechanism for compulsory licensing of drugs in Russia

Maxima Legal’s Associate, Darina Lysachkina, has written a blog for JD Supra and the IP Insider with an overview of Russian law allowing for the compulsory licensing of medicines in exceptional cases.

As part of the material, Darina noted that the Civil Code of the Russian Federation states that the use of a protected invention in an emergency is not a violation, provided that the copyright holder is notified and compensation is paid to him. Darina emphasised that until recently there was practically no judicial practice on this issue; however, against the background of an expansion of domestic legislation in this area and the coronavirus pandemic, a new round of patent disputes is possible.
