Delovoy Peterburg and Mashnews quoted Sergei Bakeshin’s commentary on attempts by the Pella shipyard to recover RUB 2.7 bn from the Russian Ministry of Defence
The Commercial Court of the Moscow District did not reconsider the decisions of lower instances that refused to allow Pella shipyard to recover RUB 700 m from the Russian Ministry of Defence. As follows from the materials of the dispute, this amount is interest for the military’s retention of the difference between the actual and contract price for the construction of the pilot vessel.
During the construction of the vessel, Pella shipyard agreed to make technical adjustments without changing the price, and attempts to revise the terms of the contract were unsuccessful, Sergei Bakeshin, Counsel, Head of Dispute Resolution & Insolvency practice at Maxima Legal, drew the attention of Delovoy Peterburg newspaper. ‘However, Pella shipyard managed to recover from the Ministry of Defence RUB 2 bn of the difference between the contract price and the actual cost of the vessel. This is already a great luck, so to expect that it will be possible to recover another RUB 700 m from the military budget would be too optimistic,’ the expert said.
