Dmytry Uryakin has explained to Novy Prospect why Darnitsa Group is suing the oil producer over the brand name
Darnitsa Group (part of Kolomensky Holding) filed a lawsuit against vegetable oil producer Aston Food Products and Food Ingredients (Aston) for early termination of legal protection of two Zateya trademarks. At the same time, according to the Federal Intellectual Property Service, Darnitsa Group applied for registration of the same name trademark in 2024. All three trademarks (two belonging to Aston and the one that Darnitsa Group plans to register) are applied for in relation to goods in the class ‘bakery products’.
The presence of the disputed trademarks prevents Darnitsa Group from entering the market under the Zateya brand, explained Dmitry Uryakin, Senior Associate at Maxima Legal, to Novy Prospect. ‘If Darnitsa Group will start to do this, it risks to receive from the right holder of a lawsuit to recover damages or compensation for the illegal use of trademarks, as well as the requirement to destroy counterfeit goods,’ the expert listed.
