Dmitry Uryakin has provided his comments to Pravo.ru on a decision of the Russian Supreme Court

The Russian Supreme Court has referred a case to be reheard which concerned the building of a hotel on land designated for residential buildings. According to the court’s position, a decision of the regional court on the possibility to resolve the shortcomings in the construction were not fully reasoned or well-founded.

 

Associate at Maxima Legal, Dmitry Uryakin, explained that the decision of the Supreme Court falls within usual court practice. “As has been noted on a number of occasions, entities that are involved in construction should evidence that the building complies with regulations relating to safety, and that the building does not pose a risk to the lives or health of third parties”, explained Dmitry to legal online portal Pravo.ru. Dmitry also clarified that in a situation when there is insufficient evidence of this, an order to demolish the unauthorised building will should be made.
