Konstantin Boytsov has helped Vecherniy Peterburg to understand the new scheme of maintenance of gas equipment in apartment buildings in St.Petersburg

According to the law, two types of contracts are required for gas equipment: one for the maintenance and repair of intra-household gas equipment and the other for the maintenance and repair of intra-apartment gas equipment. As Konstantin Boytsov, Counsel and Head of Energy & Natural Resources Practice at Maxima Legal, explained to Vecherniy Peterburg newspaper, that the first contract with an authorised service organisation is concluded by a management company and the second one directly by flat owners. Last year it was possible to join the standard form of the contract by making an advance payment of RUB 5 when paying the receipt for November. Currently, it is possible to enter into the contract under the new form via a personal account on the PetersburgGas website or through a Multifunctional Center for Рrovision of State and Municipal Services. 

Konstantin Boytsov drew attention to another way of concluding a contract for maintenance and repair of internal house gas equipment. “Apartment owners by decision of the general meeting have the right to entrust the conclusion of a single contract for maintenance and repair on their behalf to a person determined by the decision of the general meeting of the owners of premises in the apartment building”, the expert emphasised. Such a person can be not only a management company, but also an enterprising neighbour or an invited specialist. “In the absence of special rules, the said decision of the general meeting of the owners of premises in the apartment building is adopted by a majority of votes of those present at the general meeting,” added the Counsel at Maxima Legal.

Konstantin also noted that the absence of an agreement will be grounds for suspension of gas supply. But before this sanction is applied, the flat owner must be sent two notices about the upcoming gas cut-off and its reasons.
