A federal register of unfinished construction projects will appear in Russia in the near future. The register will include real estate that was built or reconstructed at the expense of the Russian Federation`s budget. It should be noted that the ability to maintain their own registers will also be available for regions of the country.

In addition, Rosreestr (the Federal Service for State Registration, Cadastre and Cartography) proposes to supplement the law “On state registration of real estate”. In particular, Rosreestr is planning to add a provision to the effect that cadastral registration and registration of title to the facility, information on which is not available in the Unified State Register of Real Estate, shall be based solely on a declaration of real estate specifying the reasons for inclusion in regional or federal registers of uncompleted capital construction projects. At the same time, if the right to the land plot on which such unfinished facility is located is not registered in the Unified State Register, state cadastral registration and state registration of the right to the land plot are not required.

“The innovations should allow to privatise state unfinished construction projects as quickly as possible in case of such management decisions and also provide an opportunity to complete problematic state construction projects through private investment, for example, on the basis of concession agreements,” Konstantin Boytsov, Senior Associate and Head of Real Estate & Construction practice at Maxima Legal, explained to Pravo.ru. According to the expert, it may be particularly relevant in respect of state infrastructure, healthcare and education facilities, construction of which has not been completed.
