Maxim Ali told Pravo.ru about changes in valuation of patent procedure

From the 1st of August the procedure of pre-valuation of patentability of utility models. Previously the service was provided by entrusted subdivision of Rospatent – The Federal Institute of Industrial Property, and now it is transferred to outsource accredited research and educational establishments. Pre-evaluation is voluntary and it’s cost is estimated by the expert company. It is possible to request the service before the beginning of valuation of the invention or utility model by Rospatent.

Maxim Ali, Partner, Head of IP/IT practice at Maxima Legal, pointed out Pravo.ru’s attention on the fact that after changing the pre-valuation procedure Rospatent will be obliged to have regard to the search results while making a desicion on patentability of any utility model. “It remains to be seen, how judgmental to the conclusions of accredited research and educational establishments Rospatent is going to be and will this help to improve application lead time” – told the expert.
