Delovoy Peterburg has written about a dispute between the Petro tobacco factory in St Petersburg and Rospatent. The Chamber of Patent Disputes and the first instance of the Intellectual Property Court refused to recognize the factory’s claim to combine its trademark “LD” and trademark “LT”, registered in the name of its competitor, the Moscow-based manufacturer of electronic cigarettes, Samarin.

As the Head of the IP/IT Practice at Maxima Legal, Maxim Ali, told the newspaper Delovoy Peterburg, Petro pays attention not only to registering and maintaining its trademarks, but also to clearing the market from trademarks that are seen to be too similar to its. “Examples are several decisions of commercial courts where individual entrepreneurs were held administratively liable (usually a fine of 50,000 roubles) for the sale of counterfeit Petro cigarettes (for example, under the logos “LD” and “Troika”)”, explained Maxim.
