Olga Finogenova has commented for Pravo.ru on a dispute that reached the Supreme Court of the Russian Federation regarding the recovery of losses incurred due to the cancellation of an international flight in 2022

In early March 2022, in connection with the recommendations of Rosaviatsia dated 5 March 2022 to suspend international flights due to the threat of aircraft arrest abroad, Aeroflot notified passengers of the cancellation of the Maldives-Moscow flight and refunded the money for the tickets. After returning to Russia, the passengers demanded compensation for losses, compensation for moral damage and a fine. The dispute reached the Supreme Court, which agreed with the plaintiffs’ position and sent the case for a new hearing, pointing out that the airline must prove that there was force majeure and it made efforts to minimise damage to customers.

Olga Finogenova, Associate at Maxima Legal, drew the attention of Pravo.ru to an important conclusion of the Supreme Court, which did not consider the carrier’s decision to follow the recommendations of Rosaviatsia as a force majeure circumstance. In addition, the expert reminded about the role of supporting evidence in such disputes, recommending plaintiffs to hand over documents confirming the default of the defendant (for example, an official notice of flight cancellation), and documents that show the amount of expenses incurred and that they were.
