Sergei Bakeshin has commented on Delovoy Peterburg about a dispute involving the co-owner of a restoration company who has incurred subsidiary liability

Tristar Investment Holdings JSC is trying to bring subsidiary liability in the amount of 4.6 billion roubles to Viktor Smirnov, co-owner of the Intarsia restoration company, which was declared insolvent in 2016. As part of the case, the claimant managed to seize the assets of a number of legal entities, which Viktor Smirnov allegedly owns through Cypriot offshore companies, however, the businessman’s lawyer assets that his client does not have any association with these entities.

As the Head of the Dispute Resolution and Insolvency practice at Maxima Legal, Sergei Bakeshin, explained to the business newspaper Delovoy Peterburg that to recover 4.6 billion roubles from Viktor Smirnov, it will first be necessary to prove his guilt in the insolvency of Intarsia. After which it will be necessary to identify his property and foreclose on it, which can also be a significant task, especially if the title owners are other persons, Sergei added.
