Sergei Bakeshin has commented on the insolvency of Petroholod JSC

NBK-Construction LLC petition for the insolvency of Petroholod JSC, affiliated with the St. Petersburg ice cream factory of the same name. According to the case file, the amount of claims is 244.5 million rubles. At the same time, shortly before receiving the petition for insolvency, Petroholod JSC decided to dissolve itself. Sergei Bakeshin, Head of Dispute Resolution and Insolvency practice at Maxima Legal, told RBC that, in connection with the decision to dissolve Petroholod, the company’s insolvency will be carried out under a simplified procedure.

“The court, recognising the petition as founded, will immediately open the final procedure – insolvency proceedings, without introducing observation and without applying any rehabilitation procedures”, explained Sergei Bakeshin. At the same time, according to him, the debtor’s decision to dissolve itself does not deprive creditors of the chances to collect debts.
