Sergei Bakeshin has provided his comments to Kommersant on the withdrawal of the accreditation of an bancrupty administrator

The fund for the protection of citizens’ rights and participants in a building construction, Dom.RF, have revoked the accreditation of bancrupty adminstratior, Daniil Fedichev. The decision was made after the parties became aware that Mr. Fedichev had incurred administrative liability in January 2016.

Head of the Dispute Resolution and Insolvency Practice at Maxima Legal, Sergei Bakeshin, explained to Kommersant that the fund does not often resort to such serious measures, since the withdrawal of accreditation of a large number of administrators could lead to a shortage. Furthermore, establishing that a violation of the law took place (a significant infringement of the rights of creditors, unjustified expenditure of the estate or disproportionate allocation of funds to creditors) are instructive and discretionary, Sergei explained.
