Sergei Bakeshin has outlined to Delovoy Peterburg the prospects of challenging the results of the expert review of the increase in the cost of state contracts

Last year, the Russian government allowed the cost of state contracts already awarded to be increased by up to 30% of the original estimate due to the rising cost of construction materials. In addition, the possibility was separately established to recalculate the contract estimate for work completed and accepted by the customer in 2021. Thanks to this measure St Petersburg road contractors expect to get around RUB 5 billion in compensation, but first they need to get a positive opinion of the reexamination that confirms the price increase. At the moment, however, due to the current geopolitical situation and the closure of markets, the cost of certain items is starting to fall.

“If the contractor does not agree with the expert assessment of the increase in contract value, it can go to court and apply for a forensic examination during the hearing of the case. This is the general procedure, there are no other mechanisms here. But I have not heard of any high-profile precedents to challenge such conclusions in court,” Sergei Bakeshin, Head of Dispute Resolution and Insolvency practice at Maxima Legal, explained to Delovoy Peterburg newspaper.
