Delovoy Peterburg newspaper asked lawyers to analyse bankruptcy practice in St Petersburg and the Leningrad Region and select cases important for business. Sergei Bakeshin, Counsel, Head of Dispute Resolution & Insolvency Practice at Maxima Legal, drew attention to the case of RedSys, once one of St Petersburg’s largest IT companies. In this case the Russian Supreme Court pointed out that any reasonable doubts about the independence of a bankruptcy trustee are interpreted against they and, in the absence of a proper refutation, lead to a refusal to approve him.

“In insolvency cases a lot depends on a bankruptcy trustee. Therefore, establishing control over him is one of the most important tasks that the participants in bankruptcy proceedings.

This judicial act opens up opportunities for simplified “removal” of bankruptcy trustees and their re-election by the changed composition of creditors”, Sergei explained the significance of the decision of the Supreme Court of the Russian Federation in the case of RedSys.
