Sergei Bakeshin has commented for the DP on the bankruptcy case with the total amount of creditors’ claims of almost 5 billion rubles

Around 2.5 years ago, Spetsosluzhivostvo CJSC seller of children’s goods opened bankruptcy proceedings, which is distinguished by a significant number of creditors and many disputed transactions as well as 4.9 billion rubles the total amount of register claims.

Sergei Bakeshin, Head of Dispute Resolution and Insolvency Practice at Maxima Legal, told the Delovoy Peterburg newspaper that the main asset of Spetsosluzhivanie CJSC has not yet been sold. “A company, who holds the property on pledge, tries to sell it as expensive as possible and is not in a hurry to reduce the price”, – explained the expert.

In addition, Sergei drew attention to the inconsistency of the case with the current trend. “As far as I know, there was no demand to bring the controlling persons to a subsidiary liability. This can still be done, and then the proceedings will last longer. Meanwhile, only an application of one co-owner of the company for recovery of losses from another has been considered. This application was denied by the court, the participants did not go to the appeal,” – said Sergei Bakeshin.
