Sergei Bakeshin commented for DP the nationalisation of Bronka port

Sergei Bakeshin - Counsel

In the beginning of December, the Russian government registered ownership of 100% of shares in Phoenix LLC, which manages the port of Bronka. It should be noted that in June, the Nikulinsky District Court of Moscow satisfied the suit of the Prosecutor General’s Office against the owners of the port on the Finnish Bay for nationalisation of its assets. The owners of Bronka intend to appeal against this decision. According to the port operator’s press service, the functionality of Bronka will be maintained for the duration of the court proceedings.

Sergei Bakeshin, Head of Dispute Resolution and Insolvency Practice at Maxima Legal, drew the attention of “Delovoy Peterburg” to the fact that nationalisation cases are rare in our country today. “Certainly, the first step of the new owner will be to change the company’s management, then an internal audit: to see what has been taken over and in what condition?” – the expert explained. At the same time, according to Sergei, at the initial stage, the actions of the new owner, regardless of whether a state-owned or a private entity came in, are not any different.
