Sergei Bakeshin has commented to DP on the court’s refusal to recover damages for the idle premises on Dumskaya Street
The Commercial Court of St Petersburg and the Leningrad Region has denied Moika 22 LLC, which is associated with banker Andrei Isaev, to recover about RUB 60 mn in damages for the idle premises on 26 Griboedov Canal Embankment from the Investigative Committee, which had imposed restrictions on access to them. In fact, these are facilities on Dumskaya Street, St Petersburg’s former main hot spot.
‘I heard that some owners of the arrested premises on Dumskaya Street could not even appeal against the arrests under the rules of the Russian Code of Criminal Procedure, as they simply could not get copies of the arrest orders. If we evaluate the decision in itself, Russian courts, as a rule, are not very willing to recover losses in the form of lost profits,’ Sergei Bakeshin, Counsel, Head of Dispute Resolution & Insolvency Practice at Maxima Legal, told Delovoy Peterburg newspaper.
