Sergei Bakeshin told Logistics in Russia whether the court’s decision to nationalise Raven Russia’s assets can be implemented quickly or not.
The Commercial Court of Moscow fully supported the claim of the Prosecutor General’s Office to transfer to the state treasury the stakes and shares of 17 companies of Raven Russia Group, which manage 16 transport terminals with a total area of 2 million square metres. Raven Russia will have a month to appeal the decision.
Sergei Bakeshin, Counsel, Head of Dispute Resolution & Insolvency Practice at Maxima Legal, explained to Logistics in Russia that, as a general rule, a court judgements are enforced after they come into legal force, i.e. after the court of appeal has issued its ruling or after the deadline for filing an appeal has expired, if no appeal has been filed.
At the same time, according to Sergei, despite the complexity and the presence of a large number of persons involved in the case, the courts manage to consider cases on nationalisation of assets surprisingly quickly.
