Maxima Legal defended the interests of the St Petersburg Philharmonic in a dispute with Lenenergo

On 21 March 2017, the Arbitration Court of St Petersburg and Leningrad region reached a decision in respect of a dispute between the D.D. Shostakovich St. Petersburg Academic Philharmonic and Lenenergo.

The team at Maxima Legal successfully represented the interests of the Philharmonic, which had been infringed by Lenenergo. The distribution company had failed to fulfil its obligations under the terms of a contract in respect of a connection to the electrical grid; the company’s contractual obligation had remained unfulfilled for a year and a half after the end date of the contract. Lenenegro only took steps to fulfil the terms of the contract after the Philharmonic had submitted a claim to Court.

The Arbitration Court of St Petersburg and Leningrad region took the side of the Philharmonic, requiring Lenenegro to complete the connection to the electrical grid and to pay to the Philharmonic a sum equal to more than 30% of the overall value of the contract. The Court did not accept the counterclaims made by Lenenegro against the Philharmonic. The network company pointed to a delay from the Philharmonic to follow technical specifications in the contract; the Court considered that the Philharmonic did not have the opportunity to comply the technical requirements due to the improper conduct on the part of Lenenergo.
