One of the key bankruptcy outcomes of 2018 was the mass application by arbitration courts of the mechanism of subsidiary liability of controlling persons for debts of companies. Thus, over the past year, 2,125 people were held liable for business obligations, which was 2.3 times higher than in 2017 and 4 times higher than in 2016. Tightening of legislation, including a significant expansion of the list of grounds for imposing liability on controlling persons, was among the factors that provoked the penetration of the corporate veil.
