Nikita Deynega has spoken about changes in approaches to tax benefit assessment at #SPIBAtaxTalks discussion meeting

On 29 October, the Finance Committee of the St Petersburg International Business Association (SPIBA) held #SPIBAtaxTalks discussion meeting. During the event the experts discussed news about the Finance Committee’s work in the Advisory Council of the Russian Federal Tax Service, the Supreme Court’s review of approaches to unjustified tax benefit as well as the tax aspects of cashless termination of intra-corporate loans.

Nikita Deynega, Head of Tax and Administrative Law Practice at Maxima Legal, commented on the recent court practice regarding qualification of certain intercompany transactions as forgiveness of debt. He also analyzed the Supreme Court findings presented in the ruling in Mary Firm’s case regarding changes in approaches to assessment of tax benefit validity. In addition, the expert reviewed the mechanism proposed by the Russian Federal Tax Service for “whitewashing” business.
