The Committee of a town-planning policy of the Leningrad region has approved new land use and development rules of Murino town. A land plot on which Renta Invest developer has planned to build a restaurant complex was changed its allowable use by a new edition of the document. The implementation of 200 million rubles project is on hold now.

А construction permit is issued on the basis of a town site development plan, Konstantin Boytsov, Head of Real estate and construction practice at Maxima Legal, explained for the Kommersant newspaper. He also stressed that the changes of the land use and development rules cannot limit the implementation of the construction project during the period of the construction permit and the town site development plan.

However, as the expert noted, if Renta Invest tries to challenge the decision to cancel the construction permit, the term of the town site development plan will be able to expire during the trial. In this case, the developer will have to get a new town site development plan. But it can be issued solely on the basis of the current edition of the land use and development rules. As well as its new edition does not allow the placement of such facilities, it won’t be possible to get the permission documentation, summarized Konstantin Boytsov.
