Sergei Bakeshin has provided his assessment for Kommersant of a dispute with LOKS and Fiskars

LOKS is currently suing the Russian subsidiary of the Finnish gardening goods manufacturing, Fiskars Group. According to LOKS, during the construction of a new assembly shop in the Tosnensky district of the Leningrad region, the company did not apply for an increase in capacity, but made an unauthorized cut in the water supply system as a result of which it owes 62.5 million rubles to the utility provider.

Head of the dispute resolution practice at Maxima Legal, Sergei Bakeshin, told Kommersant that the defendant is guaranteed to be able to prove a different cut-off date only if LOKS conducted control checks. “In general, the position of LOKS looks strong enough, unless, of course, there are technical errors in calculating the volumes of water used. But the defendant may have a chance to defend itself against the requirement to pay for the water allegedly entering the wells with fire hydrants if they were sealed”, Sergei explained.
