“Solnechnye Dary” LLC, a Kemerovo Region-based snack food producer, has filed for bankruptcy against “Tauras-Phoenix”, a supplier of equipment for the food processing industry. The conflict between the companies arose in 2019. Having identified defects in the equipment supplied by “Tauras-Phoenix”, “Solnechnye Dary” applied to court with claims for termination of the sales contract and recovery of about 9 million roubles from the defendant, which were partially satisfied. The amount of compensation was reduced to 300 thousand roubles but was later increased to 359 thousand roubles.

Commenting on the situation with the bankruptcy of “Tauras-Phoenix”, Sergei Bakeshin, Head of Dispute Resolution and Insolvency practice at Maxima Legal, drew the attention of “Novy Prospect” to the fact that at the moment “Solnechnye Dary” LLC was refused to accept the application due to violations in the procedure. “In particular, there is no information in the Unified Federal Register of Information on the Activity of Legal Entities about the intention to file a bankruptcy petition against “Tauras-Phoenix””, the expert stressed.
