Anastasia Samusenko told Mashnews whether the current situation in the world affects the enforcement abroad of Russian state court judgements

In 2020, the Commercial Procedure Code of the Russian Federation was amended to give domestic companies on Western sanctions lists the right to waive their obligations to a foreign partner to arbitrate a dispute in international arbitration and transfer it to a Russian state court. Due to the aggravation of the geopolitical situation, this amendment has become more frequently applied. Specially for Mashnews, Anastasia Samusenko, Attorney at Maxima Legal, assessed whether the current situation in the world has affected the enforcement of Russian court judgements abroad.

According to the expert, there is no problem of non-recognition of Russian court judgements by foreign courts. “Rather, their execution may be hampered due to sanctions imposed on domestic banks and companies that prevent them from carrying out the relevant transactions,” Anastasia emphasised.
