Kirill Katkov has commented for DP on Aeroflot’s attempt to prohibit Riga Airport from suing Rossiya Airlines in a foreign court

Rossiya Airlines intends to seek an injunction in a foreign court against continuing its dispute with Riga International Airport. At the same time, another claim is listed first on the commercial case card: “annulment of the arbitral tribunal’s decision”. So far, the claim has not been accepted for proceedings: first, the claimant sent the court an incomplete package of necessary documents, for example, it did not provide documents confirming the address of the location of Riga International Airport and other information identifying the foreign company.

“In this case, one should be guided by the content of the decision to leave the claim without moving,” Kirill Katkov, Associate at Maxima Legal, told Delovoy Peterburg the newspaper. “The wording in the case file is formulaic and perhaps they have not yet created a template for this type of claim,” the expert added.

It is clear from the decision not to pursue the claim that this case is about imposing a ban on Riga Airport from continuing proceedings on a dispute involving Aeroflot in a foreign court or International Commercial Arbitration outside the territory of the Russian Federation, the expert said. In this case, according to Kirill, the fact that the ban relates to proceedings in a foreign arbitration court may be connected with the cancellation of the arbitration court’s decision.
