Sergei Bakeshin has commented for the Kommersant on the attempt of the Government of the Leningrad region to increase the penalties for garbage disposal in improper places

The Government of the Leningrad region proposed to increase fines for waste disposal in improper places. The penalty amount now is up to 7 thousand rubles for individuals and up to 700 thousand rubles for businesses. The draft of the regional law imposes sanctions of up to 100 thousand and 1,5 million rubles respectively. According to the idea of authorities, toughening of responsibility will help the region to struggle against the unauthorized dumps, but the initiative didn’t get the support of the public prosecutor’s office.

Sergei Bakeshin, Senior associate at Maxima Legal told to the Kommersant newspaper that responsibility for non-compliance with requirements to disposal of production and consumption wastes is provided by the federal legislation. The expert explained that regions are allowed to establish their own amount of fines, but only if it does not contradict the Administrative Offences Code, while Leningrad region proposed the amount of fines which cannot be introduced without changes in the federal legislation.
