Natalia Diatlova has given a presentation at PPP Week

Partner and Head of the PPP Practice at Maxima Legal, Natalia Diatlova, took part in the fifth infrastructure congress ‘Russian PPP Week’ which is the largest event for the sector in Russia and the CIS.  The event was organised by the National Centre for PPP supported by federal ministries, the Chamber of Commerce, Delovoy Peterburg and the Agency of Strategic Initiatives.

Natalia Diatlova participated in the legal debate on amendments to legislation on concessions and PPP. The topic of discussion between the lawyers was the decree from the Russian government on the roadmap for the so-called infrastructure mortgage and the publication on the government’s website of a bill with amendments to the law on concession agreements and PPP legislation. The bill proposes granting powers to the Ministry for Economic Development authority to regulate the PPP sector, as well as introducing amendments to legislation. Among the important changes are the potential to organise joint competitions by public entities, reimbursing bidders for taking part in tenders, removing restrictions on government companies acting as the private partner, proposals for guaranteeing minimum income and defining the terms of ‘capital guarantee’ and ‘concessor’s fee’.

Participants in the debate developed a range of proposed amendments to the bill and discussed the prospects for future development of PPP projects in Russia.  The lawyers noted the positive influence on the market of changes to the recovering of private investor’s expenses following an initiative made by the company and the potential participation of government corporations.

“It is important that now as part of the congress leading Russian and foreign experts can together discuss significant matters connected with a uniform approach to making decisions about concession agreements and PPP partnerships, as well as providing their opinions on amendments to current legislation and to discuss these directly with representatives from the Russian Ministry of Economic Development”, commented Natalia Diatlova.

As part of the PPP Week, Maxima Legal signed two cooperation agreements with Novosibirsk region and the Republic of Bashkortostan, launching partnerships in these regions for in the PPP sector.
